Abstract

This thesis discusses the Study of Efforts to Formulate Ius Constituendum in Arrangement of Imported Apparel Trade (Case Study in Pontianak City). The research method used is Normative research method with Qualitative approach. From the result of this thesis research, it can be concluded that Implementation of Regulation of the Minister of Trade No. 51 of 2015 concerning the Prohibition of Import Used Clothes still needs to improve Supervision and Law Enforcement. Supervision and law enforcement related to illegal imports on imported used clothing in Pontianak City still not in accordance with the rules that should be. Factors causing the widespread trade of imported used clothing in the city of Pontianak one of them is due to the supervision and law enforcement is still weak. This is because law enforcers have not implemented the rules as they should. The lack of socialization on the rules that come into force and the changes to the rules on the prohibition of imported used clothing is the cause of the lack of enforcement against the ban on imported clothing. In addition, the Limitations of Human Resources that exist in Pontianak Customs and Excise agencies to oversee the Customs area is also one of the obstacles encountered in conducting surveillance. On the other hand, the Society also still can not accept the rules and do not consider it a crime or violation of law. The community also considers that imported used clothing that is relatively cheap and reachable by all circles to make imported used clothing to attract people. To overcome the rampant trade of imported second-hand clothing, the Government is expected to issue legislation regulating the specific import of quality standards (Standart Eligibility) especially for imported clothing so that it can overcome the smuggling crimes that are often repeated.
